1. Agreement and operator
These Terms & Conditions govern use of the Alboriquessavine website and your interactions with club membership, registrations, information, and organized activities. The website and club are operated by Alboriquessavine Fishing Club Inc., located at 1450 Marine Drive, North Vancouver, BC V7P 1T8, Canada.
By using this website or requesting club services, you agree to these Terms to the extent applicable to your interaction. If you do not agree, do not use restricted club services or register for activities.
2. Eligibility and information you provide
You must provide accurate, current information when requesting membership or registering for an activity. You are responsible for correcting material changes that affect your participation, contact details, or eligibility.
Youth participation may require registration or authorization by a parent or legal guardian. Certain activities may have minimum experience, equipment, or age requirements because of water access, weather exposure, or the nature of the session.
3. Acceptable website use
You may use the website for lawful personal purposes related to learning about the club, communicating with us, and accessing club information. You must not attempt to disrupt the site, gain unauthorized access, introduce harmful code, misuse forms, impersonate another person, scrape restricted information, or use club content in a misleading way.
We may change, suspend, or remove website features when reasonably necessary for maintenance, security, legal compliance, or club operations.
4. Membership
Membership is subject to acceptance, payment of applicable fees, capacity, and compliance with club rules. Membership benefits may vary by category and season. Descriptions on the website are intended to explain the current program but do not guarantee that every activity, piece of equipment, or benefit will be available at all times.
Membership is personal and may not be transferred without written club approval. Members are expected to act respectfully toward volunteers, other members, landowners, venue staff, and other water users.
5. Organized activities and schedule changes
Fishing and outdoor activities are affected by weather, water levels, access, seasonal restrictions, volunteer availability, transportation, group capacity, and other conditions. We may move, modify, postpone, shorten, or cancel an activity when reasonably necessary.
Participants must follow trip briefings, remain within designated activity areas, use required safety equipment, and follow reasonable directions from the trip lead. A participant may be asked not to enter a particular area or to stop an activity if the trip lead considers continued participation unsuitable for the conditions or group.
Each participant remains responsible for personal preparation, clothing, food, hydration, travel arrangements unless expressly included, and any licence or permission required by law.
6. Fishing rules, licences, and access permissions
Members and guests are responsible for knowing and following applicable federal, provincial, local, and site-specific fishing rules, including licences, species restrictions, seasons, closures, gear rules, retention rules, access requirements, and protected areas.
Club information is not a substitute for current official regulations. Conditions and rules can change, and participants must confirm the requirements that apply on the day of an outing.
Private property, restricted access, and posted conditions must be respected. Club membership does not create a right of access to any property or water.
7. Club equipment and personal property
Shared equipment may be available only during eligible organized activities and is subject to availability, suitability, supervision, and club procedures. Borrowers must use equipment carefully, report damage or loss promptly, and return items in the agreed condition, allowing for ordinary wear.
The club is not responsible for loss, theft, or damage to personal property except to the extent liability cannot lawfully be excluded. Participants should keep personal equipment organized and secure.
8. Fees, renewals, and cancellations
Membership and activity fees, where applicable, are shown or communicated before payment is requested. Fees may change for future membership periods or future activities. A price change will not retroactively alter a completed payment.
Cancellation, credit, or refund terms may depend on the type of activity, expenses already committed, and the timing of cancellation. If the club cancels a separately paid activity, we will communicate the available remedy, which may include rescheduling, a credit, or a refund depending on the circumstances.
Membership fees support ongoing club operations and are not a guarantee that a particular number of outings will occur.
9. Website content and intellectual property
Unless otherwise stated, website text, layout, graphics, and original club materials are owned by or licensed to the club and are protected by applicable intellectual property laws. You may view and print reasonable portions for personal, non-commercial use.
You may not reproduce substantial portions of the website for commercial use, remove rights notices, falsely attribute club materials, or present club content in a way that implies an endorsement or partnership that does not exist.
Photos or materials submitted by members will only be used as permitted by the applicable submission terms or separate permission.
10. Privacy
Our handling of personal information is described in the Privacy Policy. By using inquiry or membership processes, you acknowledge that information may be handled as described there.
Do not submit confidential information through general website forms unless we specifically request it for a defined purpose.
11. Outdoor risk and limitation of liability
Fishing and outdoor activities involve inherent risks, including changing weather, slippery or uneven ground, moving water, cold water, hooks, lines, boats, docks, falling objects, remote access, wildlife, equipment failure, and actions of other participants or members of the public. Participants are expected to exercise reasonable care and follow safety instructions.
To the fullest extent permitted by applicable law, the club does not guarantee that the website, information, outings, or equipment will be uninterrupted, error-free, suitable for every participant, or free from all risk. Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.
Website information is general club information and should not be treated as a guarantee of current field conditions, regulatory status, access, or trip suitability.
12. Responsibility for your conduct
To the extent permitted by law, you are responsible for losses or claims arising from your unlawful conduct, deliberate misconduct, material breach of these Terms, damage you intentionally cause, or infringement of another person's rights.
Any indemnity obligation will be interpreted only to the extent enforceable under applicable law and will not require you to indemnify the club for liability that cannot lawfully be shifted to you.
13. Suspension or termination
We may suspend or end access to club activities or membership for serious or repeated rule breaches, unsafe conduct, harassment, misuse of property, non-payment, unlawful conduct, or behaviour that materially disrupts the club's ability to operate.
Where appropriate, we may first provide a warning or an opportunity to correct the issue. Immediate action may be taken where reasonably necessary for safety, legal compliance, or protection of participants and property.
14. Governing law and disputes
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without excluding mandatory consumer or privacy rights that apply to you under another law.
Before starting formal proceedings, the parties should make a reasonable effort to resolve a dispute through written communication. Unless another forum is required by mandatory law, disputes may be brought before courts of competent jurisdiction in British Columbia.
15. Changes and contact
We may update these Terms when club operations, services, legal requirements, or website functionality change. The current version will be identified by the “Last updated” date. Material changes will apply prospectively unless a different approach is required by law.
